Faruqi & Faruqi is representing a proposed nationwide class of HP consumers asserting that HP designs its printers to use more expensive, color ink when users print in only black and white. Plaintiffs also challenge HP’s decision to cut off users’ ability to print when the color ink runs out, even if plenty of black ink is available.
On November 15, 2021, Faruqi & Faruqi achieved a significant win against the industry giant, defeating HP’s second attempt to dismiss the case. Judge Vince Chhabria of the Northern District of California issued an order allowing Plaintiffs to pursue their claims that HP’s conduct is fraudulent and violates various states’ consumer protection statutes. This success follows Faruqi & Faruqi’s victory on December 29, 2020, where Judge Chhabria denied HP’s first attempt to dismiss Plaintiff’s complaint. Faruqi & Faruqi will continue to vigorously litigate this lawsuit on behalf of the Plaintiffs and proposed classes.
