Faruqi & Faruqi Commences Action Against HP Inc.
On April 10, 2020, Faruqi & Faruqi filed a consumer protection and false advertising class action against HP Inc. regarding the marketing and sale of certain color printers. The complaint seeks to hold HP liable for failing to adequately disclose that its printers use substantial amounts of color ink when printing images and text in black and white, a process known as “underprinting.” The complaint also alleges that HP fails to adequately disclose that the printers are designed to stop printing when the color ink is depleted, even when the consumer wants to print in black and white only. The lawsuit seeks to address the financial injuries suffered by consumers as a result of HP’s deceptive practices.
The case is docketed as Rose v. HP Inc., No. 5:20-cv-02450 in the United States District Court for the Northern District of California. The complaint can be found here.
