On May 8, 2019, Judge P. Kevin Castel of the Southern District of New York denied Hudson’s Bay Company’s motion to dismiss plaintiff’s first amended complaint, sustaining numerous claims against the retail chain. Hudson’s Bay Company is the parent company for all Saks OFF 5TH, Saks Fifth Avenue, and Lord & Taylor stores nationwide. The Court declined to dismiss plaintiff’s allegations that the company’s massive data breach, which exposed millions of its consumers’ credit and debit card information, resulted in financial losses to the proposed class.
