Faruqi & Faruqi Defeats Motion to Dismiss in Consumer Data Breach Class Action Against Saks

Faruqi & Faruqi Defeats Motion to Dismiss in Consumer Data Breach Class Action Against Saks

On May 8, 2019, Judge P. Kevin Castel of the Southern District of New York denied Hudson’s Bay Company’s motion to dismiss plaintiff’s first amended complaint, sustaining numerous claims against the retail chain. Hudson’s Bay Company is the parent company for all Saks OFF 5TH, Saks Fifth Avenue, and Lord & Taylor stores nationwide. The Court declined to dismiss plaintiff’s allegations that the company’s massive data breach, which exposed millions of its consumers’ credit and debit card information, resulted in financial losses to the proposed class.

Faruqi & Faruqi has extensive knowledge and expertise in data breach class actions, representing consumers and shareholders nationwide in actions against Uber, Wendy’s, Arby’s, and Home Depot. A copy of the Court’s order can be found below. Faruqi & Faruqi attorneys Timothy J. Peter and Nina Varindani are heading this litigation.
