Plaintiff filed a verified shareholder derivative complaint on behalf of nominal defendant Mattel, Inc. (“Mattel” or the “Company”) in the Court of Chancery of the State of Delaware against certain directors and officers of Mattel (the “Individual Defendants”). The action alleges claims for breach of fiduciary duty and unjust enrichment against the Individual Defendants in connection with the marketing and sale of the Rock ‘n Play Sleeper, which was subsequently recalled in April 2019 due to alleged safety issues which allegedly resulted in the death of at least 32 infants. The action was consolidated with a subsequently filed related derivative action and is currently stayed pending the resolution of a related consumer class action.
