Faruqi & Faruqi represents a proposed class of independent truck stops against fleet card issuer Comdata and the largest chain truck stops in the United States for abuse of monopoly power and tying and bundling in violation of §§ 1 and 2 of the Sherman Act. Plaintiffs allege that the defendants entered into anticompetitive contracts whose terms forbid the chain truck stops from competing with Comdata in the fleet card market, and required the chain truck stops to discourage truckers from using any card but Comdata. In return, Comdata charged the chain truck stops low transactions fees compared to the fees charged by Comdata to the plaintiffs. As a result of those anticompetitive contracts, plaintiffs paid artificially inflated transaction fees for all Comdata fleet card transactions.
