New York City is among a small but growing number of jurisdictions that have enacted protections against height and weight discrimination. Under the New York City Human Rights Law, employees and job applicants are protected from discrimination based on their height, weight, or body size. Since November 26, 2023, employers generally may not base employment decisions—including hiring, promotions, compensation, job assignments, or termination—on an individual’s height or weight. The law also prohibits harassment, hostile work environments, and other forms of unequal treatment related to body size. These protections extend beyond the workplace to housing and places of public accommodation, reflecting the City’s commitment to promoting fair and equitable treatment for all individuals.

While the law recognizes limited exceptions where height or weight may be considered, those exceptions are narrowly defined and apply only in specific circumstances. In most situations, body size cannot lawfully influence employment opportunities, advancement, compensation, or other terms and conditions of employment.
