California Judge Agrees with Faruqi & Faruqi in Putative Class Action Against Defendant Johnson & Johnson that Aveeno Baby Products May Be Misleading

On August 9, 2023, United States District Judge Jesus Bernal ruled on Johnson & Johnson Consumer Inc.’s motion to dismiss in Schippell v. Johnson & Johnson Consumer Inc., Case No. 5:23-CV-00410-JGB-SHK (C.D. Cal.).  Judge Bernal stated that all causes of action, other than the claim for negligent misrepresentation, would likely survive the pleadings stage once the Complaint was amended to specify the damages.  Further, the court rejected Defendants other arguments regarding standing, the reasonable consumer standard, and equitable relief.  The Order also stated that Plaintiff “need only revise a paragraph or two of the Complaint for this action to survive the pleadings stage” and that once the amended allegations have been filed, a second motion to dismiss would be “unnecessary and inappropriate.”  The Amended Complaint will be filed by August 18, 2023.
