Court Grants Collective Certification in the Mercado Action

Judge Analisa Torres of the United States District Court for the Southern District of New York ordered conditional certification of a collective action brought by Bridge and Tunnel Officers against the Metropolitan Transportation Authority and the Triborough Bridge and Tunnel Authority, in the action titled: Mercado et al. v. Metropolitan Transportation Authority et al., 1:20-cv-06533 (S.D.N.Y.).  The Court found that the Officers made a sufficient showing that they were similarly situated under the Fair Labor Standards Act.  At this time, approximately 445 Officers have already joined the Mercado Action. The Court ordered that notice be issued to the remaining members of the collective apprising them of the lawsuit and their right to participate in same.
