Faruqi & Faruqi Defeats Motion to Dismiss in Pet Food Mislabeling Case

On December 30, 2020, Faruqi & Faruqi, LLP successfully defeated a motion to dismiss in a class action brought against Big Heart Pet Brands, Inc., the maker of Nature’s Recipe®.  The case is brought by a California consumer alleging that the company deceptively marketed and sold its pet food products as “All Natural,” when in fact, they contain artificial and/or synthetic ingredients. 

The case is docketed as Pennie Roper v. Big Heart Pet Brands, Inc., No. 1:19-cv-00406 in the United States District Court for the Eastern District of California.  A copy of the court’s decision can be found here.
