FARUQI & FARUQI, LLP FILES COMPLAINT AGAINST NINTENDO OVER SWITCH’S JOY-CON DRIFT
On October 5th, 2020, Faruqi & Faruqi filed a consumer protection and false advertising class action against Nintendo of America Inc., regarding a defect in its Switch Joy-Con gaming console controllers. The defect, also known as “Joy-Con Drift” to gamers, causes the controllers to register movement even when they are not in use, which limits the overall gameplay experience. The complaint seeks to hold Nintendo liable for failing to adequately disclose this issue. The lawsuit seeks to address the financial injuries suffered by consumers as a result of Nintendo’s deceptive practices.
The case is docketed as Sanchez et al v. Nintendo of America, No. 3:20-cv-06929 in the United States District Court for the Northern District of California. The complaint can be found here.
