Is it alright for my employer to pay me late?

Hi, my name is Innessa Huot, and I’m an employment attorney.

It is a violation of the federal law, as well as most state and city laws, for your employer to pay you even one day after your regularly scheduled payday. Now, the reason for this is because most employees live paycheck to paycheck, and it causes severe hardships for your employer to be late with your paycheck, even just one day. Now the federal law provides what’s called liquidated damages, which is double damages for any such late payments going back three years. New York state has a very similar law that provides for these double damages going back six years. Now, if your employer is not paying you your wages on time, it’s highly likely that they’re committing a whole lot of other wage violations.
