A contingency fee is a type of attorney's fee where, rather than collecting periodic payments throughout the pendency of the litigation, the attorneys are paid a percentage of the recovery at the end of the case. A contingency fee is payable only if there is a favorable result for the class and, in securities class actions, the contingency fee must be approved by the court.
